Terms of Service

1. Agreement

These Terms of Service govern your access to and use of OnboardHero.app (the Service), operated by Fractional Labs Inc, 1130 Ogletown Rd, Suite 2, Newark, DE, 19711-5689, United States (the Company, we, us).

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you are accepting on behalf of a company, you confirm you have authority to bind that company.

2. The Service

The Service provides automated, one to one onboarding calls for your users. Features may change over time as the Service is improved. We may add, modify, or remove functionality provided the core Service remains materially available.

3. Accounts

You are responsible for the accuracy of your account information and for all activity that occurs under your credentials. Keep your credentials confidential and notify us promptly of any unauthorized use.

4. Subscriptions, fees, and cancellation

Subscriptions are billed in advance on a recurring monthly basis at the plan price shown at checkout. Fees are non refundable except where required by law.

You may cancel at any time. Cancellation takes effect at the end of the current billing period and you retain access until then. We may change pricing with at least thirty days notice before your next renewal.

5. Acceptable use

You agree not to use the Service to break the law, infringe the rights of others, transmit malicious code, attempt to gain unauthorized access, reverse engineer the Service, or resell the Service without our written consent.

6. Your content

You retain ownership of the product information, documentation, and other materials you provide. You grant us a limited license to process that material solely to operate and improve the Service for you.

You are responsible for having the rights and permissions needed for anything you provide, including any notices or consents required for calls with your users.

7. Confidentiality

Each party will protect the other party's confidential information with at least reasonable care and will use it only to perform under these Terms.

8. Intellectual property

The Service, including its software, models, interfaces, and branding, remains the property of the Company. No rights are granted except those expressly stated in these Terms.

9. Disclaimers

The Service is provided on an as is and as available basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability arising out of these Terms will not exceed the fees you paid in the twelve months preceding the event giving rise to the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms and do not cure the breach within fifteen days of notice, or immediately where required for security or legal reasons.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. The courts located in Delaware will have exclusive jurisdiction.

13. Changes and contact
